Coach directory terms of use
Part A: For all users
§ 1 Provider and scope
(1) The coach directory on iron-stead.com is operated by Ironstead, owner Jakob Michael Seiffert, Kentroper Weg 60a, 59063 Hamm, Germany, email contact@iron-stead.com ("Ironstead"). Ironstead receives notices of illegal content and complaints under these terms at abuse@iron-stead.com. This address is also the single point of contact under Art. 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act, "DSA"); communication is possible in German or English.
(2) These terms apply to the use of the coach directory (the "directory"): viewing and posting coach profiles, requests to coaches, posts in which athletes describe the coaching they are looking for ("athlete posts"), offers by coaches on athlete posts, reviews, replies to reviews and notices.
(3) A "coach" is anyone who posts or submits a profile in the directory with an Ironstead coach account. An "athlete" is anyone who uses the directory with an Ironstead account to look for a coach, send a request, publish an athlete post or leave a review. "Users" are coaches, athletes and visitors of the directory. "Content" is any information, text and image that users post in the directory.
(4) Parts A and D apply to all users, Part B only to coaches, Part C only to athletes. Only someone who offers coaching as a business, for example through a company or as a freelancer or self-employed coach, can post a profile. Such a coach acts as a trader under consumer law (§ 14 of the German Civil Code, BGB); the coach confirms this on submission (§ 7(2)). Athletes are usually consumers (§ 13 of the German Civil Code). Rights that consumers have by law and that cannot be excluded or restricted by contract remain unaffected by these terms.
(5) For coaches, Ironstead's General Terms and Conditions (the "GTC") also apply. In matters of the directory these terms take precedence over the GTC. Users' own terms and conditions do not apply to Ironstead.
(6) How Ironstead processes personal data in the directory is described in the privacy policy, section "Coach directory".
§ 2 Ironstead's role
(1) The directory is software that lets coaches present their services and lets athletes contact coaches. Ironstead provides no coaching services of its own through the directory and does not recommend coaches.
(2) A contract for coaching services (the "coaching contract") is concluded solely between coach and athlete. Ironstead is not a party to that contract and does not represent either side. Coach and athlete agree content, scope, term, price and payment of the coaching directly with each other. Ironstead does not process payments between coach and athlete.
(3) When a coach accepts a request or an athlete accepts an offer, Ironstead connects both accounts in the Ironstead app. If the connection depends on a free place with the coach, it becomes active as soon as one is available. The technical connection alone contains no agreement on coaching services. Whether, and on what terms, coach and athlete conclude a coaching contract depends on their separate arrangements.
(4) Using the directory is free of charge for coaches and athletes. Ironstead charges no commission, no placement fee, no listing fee and no fee for a better position. This does not affect the fee a coach pays under the GTC for using the Ironstead software. An athlete gained through the directory counts like any other active athlete; the fee does not depend on the price of the coaching.
(5) Before a profile is published for the first time, Ironstead checks it for completeness and plausibility (§ 7(3)); later it checks only changes under § 7(4). This check is not a recommendation and not an assessment of coaching quality. It confirms neither the coach's identity nor their qualifications, experience, prices or legal notice details. The coach alone is responsible for this information (§ 8). After publication Ironstead does not generally monitor content; it follows up on notices (§ 14).
(6) Ironstead does not owe any particular result, in particular not that an athlete finds a coach or that a coach receives requests. Ironstead may change functions of the directory where this is necessary to adapt it to technical developments, changed security requirements or a change in the law or case law, or to improve functions, and where the change is reasonable for users. Users incur no costs from such changes. If a change has more than an insignificant adverse effect on consumers' use of the directory, Ironstead informs them by email in good time beforehand about the nature and date of the change and their right to end the contract. § 18(4) applies to discontinuing the directory.
§ 3 Account and minimum age
(1) Anyone can view profiles without an account. Requests, athlete posts, offers, reviews and notices through the report function require an Ironstead account.
(2) Coaches and athletes must be at least 18 years old. Before the first request, the first athlete post or the first review, the athlete confirms that they are of age.
(3) Users provide truthful information, keep their login details secret and use only their own account.
§ 4 Rules for all content
(1) The user who posts content is responsible for it. In particular, content is not permitted that a) violates applicable law, for example by insult, defamation, threats, incitement to hatred or depictions of sexual abuse; b) infringes third-party rights, in particular copyright, trade mark or personality rights, for example a photo the user holds no rights to; c) contains false statements of fact or misleading information; d) demeans or harasses people on any of the grounds listed in § 1 of the German General Equal Treatment Act (AGG); e) advertises goods or services unrelated to coaching, or contains spam, chain letters or links to malware; f) advertises or offers doping substances or prescription-only medicines; g) discloses personal data of other people without a legal basis, for example addresses, phone numbers or photos; information about the reviewed coach and their coaching in a review under § 13 is permitted.
(2) Requests, athlete posts, offers and reviews have no field for health information and are not intended for it. Users do not enter information about injuries, illnesses, medication or other health data there. The athlete discusses such information directly with their coach after the connection. If Ironstead becomes aware of such information, it deletes the free text concerned.
(3) Users use information about other users from the directory only to initiate and carry out coaching. Use for advertising or other purposes is not permitted.
(4) Ironstead does not check content before it is published, except for the first approval of a profile (§ 7(3)) and profile changes under § 7(4). Ironstead may block or remove content that violates applicable law or these terms in accordance with § 15.
§ 5 Rights in content
(1) The rights in content remain with the user. The user grants Ironstead the non-exclusive, royalty-free right, unlimited in territory, to store, reproduce, make publicly available and technically adapt the content for display in the directory, for example in format or size. This right is limited to the purpose of the directory. Ironstead does not use content for advertising outside the directory and does not let third parties use it for their own purposes.
(2) The right ends when the user deletes the content or their account. For reviews the following applies instead: if an athlete deletes their account without deleting their reviews as well, the reviews remain without their name (§ 13(6)). To that extent the right continues until the review is deleted. Statutory retention and evidence duties remain unaffected.
(3) Published coach profiles are publicly accessible and can be found through search engines. Requests, athlete posts and offers are not public. There are no further distribution channels or affiliate programmes through which Ironstead markets coaches' offers.
§ 6 Order of profiles
(1) The directory shows all published profiles that match the selected filters. Filters are specialty, language and "accepting athletes". They change only the selection, not the order. The order follows from three main parameters, in this order of priority: 1. Availability. Profiles of coaches who accept athletes come before profiles marked "Currently fully booked". A profile is fully booked if the coach has stated that they are not accepting athletes, or if they have not used Ironstead for 30 days. This parameter carries the most weight because fully booked coaches cannot receive requests. 2. Response rate. Within each of the two groups, Ironstead orders profiles by the share of requests of the last 90 days that the coach accepted or declined within 72 hours. Only requests that athletes sent through the profile count, not offers on athlete posts. Requests withdrawn by the athlete and open requests younger than 72 hours do not count. If a coach received fewer than 5 requests in the last 90 days, Ironstead uses a uniform starting value of 50 percent, because a few requests do not give a reliable rate. This parameter carries the second most weight because a prompt answer helps athletes in their search. 3. Daily random order. Ironstead orders profiles with the same value at random. The order changes every day at 00:00 UTC and is the same for all visitors on a given day. This way no profile keeps the same position permanently by chance alone.
(2) Nothing else influences the order, in particular not payments, the coach's plan or trial status, reviews or profile views. Paid placement does not exist. The order is the same for all visitors and is not personalised. Ironstead does not show the response-rate value publicly. A profile of the operator of Ironstead is labelled as such and placed by the same rules.
(3) If Ironstead changes the main parameters, § 18(2) applies towards coaches.
Part B: For coaches
§ 7 Profile and approval
(1) The coach creates their profile in the dashboard and submits it for review. Mandatory details are display name, profile photo, short description of at most 500 characters, at least one specialty from the given list, at least one language and a legal notice (§ 8(3)). Location, qualifications, a link to the coach's own website and a price "from €… per month" with a price note (§ 8(4)) are optional.
(2) By submitting, the coach offers to take part in the directory under these terms and confirms that they offer coaching as a business (§ 1(4)). Ironstead stores this confirmation and the accepted version of these terms. The contract for participation is concluded with the first approval.
(3) Ironstead approves a profile if the following conditions are met, and rejects it otherwise: a) all mandatory details are present, the coach has confirmed that they offer coaching as a business, and the profile photo is not locked; b) the details are plausible and recognisably describe coaching in strength sports offered as a business or profession; c) legal notice details or a link to a legal notice are present; d) the content does not violate § 4 or § 8; e) there are no concrete indications that the coach was previously removed from the directory, misused it, or intends to evade a measure under § 15 or their previous reviews by deleting their account and registering again. Previous reviews alone are not a ground for rejection.
If Ironstead rejects a profile, it tells the coach the reasons (§ 16). The coach can revise the profile and submit it again.
(4) After the first approval, changes to the profile are visible immediately, without another review by Ironstead. This does not apply to changes that add or change a link, an email address or a phone number in a free-text field (display name, short description, qualifications, location, price note, other required details), to changes to the link to the legal notice, or to changes to the website link. The system detects such changes automatically; a person at Ironstead examines them before they become visible. Ironstead accepts the change if it does not violate § 4 or § 8. Until the decision: a) The last approved version of the profile stays visible. Ironstead tells the coach in the dashboard that the changed version becomes visible after the check. b) The coach can keep editing the changed version; every further change becomes part of the same check. If they remove the link or contact detail again, the version becomes visible without a check. They can also discard the changed version. c) The coach can choose to hide the previous version until the decision. While it is hidden, the profile does not appear in the directory, athletes cannot send requests and the coach cannot make offers on athlete posts; the coach can still answer requests already sent.
If Ironstead accepts the change, it replaces the previous version and the coach is informed by email. If Ironstead rejects it, the previous version stays visible, hiding under (c) ends, and the coach receives a statement of reasons (§ 16). The profile must always contain all mandatory details. A replaced profile photo is subject to the notice procedure (§ 14) and the provisional lock (§ 15(3)).
(5) The coach states in the profile whether they accept athletes. If not, the profile stays visible with the note "Currently fully booked" but without the option to send a request. If the coach does not use Ironstead for 30 days, Ironstead automatically shows the profile as fully booked and informs the coach by email. As soon as they use Ironstead again and the profile states that they accept athletes, the note disappears.
§ 8 Coach's responsibility
(1) The coach is responsible for all information in their profile, their offers and their replies to reviews. They keep it correct, complete and up to date. This applies in particular to qualifications, training, licences, experience, achievements, languages, location, prices and availability.
(2) The coach states only qualifications and professional titles that they have acquired and are entitled to use. They offer medical or other healing services in the directory only if they are authorised to practise them. Promises of healing are not permitted.
(3) Regardless of statutory information duties, every coach is contractually required to provide at least their name, an address at which legal documents can be served and an email address, either in the profile's legal notice fields or through a link to their own legal notice containing those details. The coach provides in the profile the provider information required by the law that applies to the coach (for coaches based in Germany, § 5 of the German Digital Services Act, Digitale-Dienste-Gesetz, DDG), either in the legal notice fields or as a link to their own legal notice. The fields are name, a postal address at which legal documents can be served, email address and the free-text field "Other required details". In that field the coach enters whatever else that law requires of them, for example a VAT identification number, an entry in the commercial register or a comparable register, the competent supervisory authority or, for a regulated profession, the chamber or professional body and the professional title. The coach ensures that the legal notice is complete, correct and reachable. Ironstead only checks whether details or a link are present.
(4) If the coach states a price, it is the lowest monthly price at which they actually offer a coaching service described in the profile, as a total price in euros including any VAT and all unavoidable price components. If the price requires a minimum term, a mandatory one-off payment or payment other than monthly, the coach states this in the "Price note" field; Ironstead shows the note directly with the price. Ironstead shows the price as the coach states it, labelled "(as stated by the coach)".
(5) The coach fulfils all obligations towards athletes that apply to them as the provider of the coaching. These include in particular pre-contractual information duties, for distance contracts the information on a right of withdrawal, and the duties of a data controller for the data they receive from requests, athlete posts and offers. Ironstead shows on the profile that, by the coach's own statement, they offer their services as a business (a trader).
(6) The coach indemnifies Ironstead against claims that third parties assert against Ironstead because the coach's content or coaching infringes their rights, to the extent the coach is responsible for the infringement. The indemnity covers reasonable costs of legal defence. Ironstead informs the coach of such claims without undue delay and gives them the opportunity to comment.
§ 9 Requests, athlete posts and contact
(1) The coach sees incoming requests in the dashboard and in the app with the athlete's first name (without a first name: "Athlete"), the details on goal, experience and training days per week, and the message. The coach sees the athlete's email address only once the connection is active. The coach is not obliged to accept a request. Unanswered requests expire after 14 days. How quickly the coach answers is part of the order (§ 6).
(2) A coach with a published profile sees open athlete posts with the athlete's first name and the details of the post, without contact details. The coach does not see posts of athletes they are actively connected with or with whom there is an open connection request. The coach can make exactly one offer on each athlete post. The offer relates to that post and contains no advertising unrelated to it. The coach can withdraw their offer as long as the athlete has not accepted it.
(3) The coach contacts an athlete only by answering their request or making an offer on their athlete post. They do not write to athletes unsolicited, including through other channels. They use information from requests, athlete posts and offers only to talk to that athlete about coaching and to carry it out. Advertising to athletes who declined the coach's request, withdrew their request or did not accept the coach's offer is not permitted.
(4) Access to data (Art. 9 of Regulation (EU) 2019/1150): the coach receives the data under paragraphs 1 and 2 and the reviews about them and their replies. Ironstead stores the details from requests, athlete posts, offers and reviews, the coach's response times and the daily view counts of their profile, and uses them to operate the directory, to form the order (§ 6) and to evaluate the use of the directory in aggregated form. Ironstead does not make non-public data of a request available to any other coach. Athlete posts are visible to the group of coaches described in § 12(2); published reviews are public. For hosting, email and push delivery Ironstead uses the service providers named in the privacy policy. Ironstead does not make the internal aggregated evaluations, the response rate or the view counts available to coaches; statutory access rights remain unaffected. The coach can retrieve their own data through their account's data export, also after their participation ends, as long as their account exists. After the account is deleted, they can assert claims regarding data still stored by email to datenschutz@iron-stead.com.
§ 10 Unlisting, account deletion, termination
(1) The coach can unlist their profile at any time in the dashboard and relist it, unless Ironstead has unlisted it under § 15. The coach can end their participation in the directory at any time without notice by unlisting the profile or deleting their account.
(2) When a profile is unlisted, it disappears from the directory immediately. Open requests to the coach count as declined; Ironstead informs the athletes. Open offers by the coach are withdrawn. Existing connections and coaching contracts remain unaffected. Reviews are hidden while the profile is unlisted and become visible again when it is relisted. If the coach deletes their account, Ironstead deletes their profile, their offers and the reviews about them. If the coach was removed from the directory, if there is an internal note with documented facts about misuse, or if the average of at least 3 reviews is below 3.0 stars, an abuse-prevention entry remains stored as described in the privacy policy.
(3) Ironstead may terminate a coach's participation in the directory with 30 days' notice if there is a ground under § 15(1), if the profile permanently no longer meets the conditions of § 7(3), or if Ironstead discontinues or substantially redesigns the directory. The termination is sent by email and states the reasons. Ironstead may terminate without notice if a) a legal obligation or an obligation ordered by an authority does not allow the notice period to be observed, b) there is good cause under § 314 of the German Civil Code (BGB), for example a serious violation of the law, or c) Ironstead can demonstrate that the coach has repeatedly violated these terms.
A termination without notice states which of the grounds (a) to (c) applies. With a termination with notice, the profile stays published until the termination takes effect. Ironstead unlists it earlier only if there is a separate ground under § 15(1) and unlisting is necessary and proportionate; Ironstead gives reasons for the unlisting under § 16.
(4) Removal from the directory (§ 15(2)(d)) requires a ground under § 15(1). Ironstead then unlists the profile at once and at the same time terminates participation with the 30-day notice period under paragraph 3 or, in a case under paragraph 3 (a) to (c), without notice.
(5) The coach's Ironstead account and their contracts under the GTC remain unaffected by the end of their participation in the directory, unless § 15(2)(e) applies.
Part C: For athletes
§ 11 Requests
(1) By sending the first request, the first athlete post or the first review, the athlete accepts these terms. Ironstead stores which version they last accepted and when, and confirms the contract to them by email with the text of these terms.
(2) A request contains details on goal, experience and training days per week and optionally a message. An athlete can have at most 3 open requests at the same time. They cannot send a request to a coach they are connected with or who is fully booked.
(3) The coach sees the request with the athlete's first name (without a first name: "Athlete"). Once the connection is active, the coach sees, as with any connection in Ironstead, the athlete's name, email address and the training data that Ironstead shows to coaches of connected athletes.
(4) The athlete can withdraw a request as long as the coach has not accepted it. If the coach does not answer a request within 14 days, it expires; Ironstead informs the athlete.
(5) If the coach accepts the request, Ironstead connects the accounts (§ 2(3)). The athlete agrees the coaching contract, its price and payment directly with the coach. The athlete pays nothing to Ironstead.
(6) Athletes who are consumers have a right of withdrawal under the withdrawal information at the end of these terms.
§ 12 Athlete posts and offers
(1) An athlete can have one open athlete post at a time. It contains details on goal, experience and training days per week and optionally a message. The athlete can change or close it at any time. It expires after 30 days.
(2) The athlete post is visible only to logged-in coaches with a published profile, with the athlete's first name and the details of the post, without contact details. It is not public and cannot be found through search engines. Coaches the athlete is actively connected with, or with whom there is an open connection request, do not see the post. If the connection to a coach is paused or still waiting for activation, that coach may see the post.
(3) Each coach can make exactly one offer on an athlete post. Ironstead informs the athlete. The athlete is free to decide whether to accept an offer. If they accept one, Ironstead connects the accounts (§ 2(3)), the athlete post is closed and the other offers count as declined. § 11(3) and (5) apply accordingly.
§ 13 Reviews
(1) Where Ironstead offers the review function, an athlete can review a coach if their connection with that coach in Ironstead was active for at least 30 days in total. Periods in which the connection was paused do not count. Periods from an earlier connection with the same coach do count. Each athlete can review each coach once. A coach cannot review themselves, including through a connection with themselves.
(2) A review consists of 1 to 5 stars and optionally a text of at most 500 characters. The athlete can change or delete their review at any time. They can no longer change a review that Ironstead has hidden.
(3) A review reflects the athlete's own experience with this coach's coaching. Opinions, including critical ones, are permitted. Not permitted are false statements of fact, insults and abusive criticism, health information, personal data of third parties, and reviews given in return for a benefit, on someone else's behalf or about oneself.
(4) The coach can reply publicly once to each review. Paragraph 3 applies to the reply accordingly. The coach does not offer benefits for reviews and does not pressure athletes to change or delete a review. If the coach considers a review impermissible, they report it under § 14.
(5) Ironstead shows reviews with the athlete's first name on the coach's profile as long as the profile is published, newest first. Ironstead shows an average of the stars only from 3 reviews. Ironstead does not change reviews and does not sort or filter them by number of stars. A review disappears if the athlete deletes it, if Ironstead removes it under § 15 or grants a justified erasure request, or if the reviewed coach's account is deleted.
(6) When the athlete deletes their account, they can choose in the deletion dialog to delete their reviews as well. If they do not, the reviews remain with stars and text; instead of their first name it shows "Former athlete", and the review is no longer linked to their account. On request Ironstead deletes such a review if the former athlete makes it credible that it is theirs; a message to datenschutz@iron-stead.com is enough.
(7) How Ironstead checks reviews is explained in the section "How we check reviews".
Part D: Notices, measures, liability, final provisions (for all users)
§ 14 Notices (Art. 16 DSA)
(1) Logged-in users report content through the report function next to the profile text, the profile photo, an athlete post, an offer, a review or a reply to a review. Anyone, including without an account, can report content by email to abuse@iron-stead.com; this also applies to requests, which have no report function.
(2) In the notice, describe as precisely as possible the content concerned, where it can be found (link or name of the profile) and why you consider it illegal or a violation of these terms. Give your name and email address and declare that your information is correct and complete to the best of your knowledge. For notices concerning offences under Art. 3 to 7 of Directive 2011/93/EU, in particular depictions of child sexual abuse, name and email address are not required; you can also report such content anonymously to the German hotlines jugendschutz.net or Internet-Beschwerdestelle (internet-beschwerdestelle.de). Ironstead also examines incomplete notices where they allow an examination. For notices through the report function, Ironstead assigns the account automatically.
(3) Ironstead confirms receipt of a notice to the person reporting by email if they can be reached electronically. A person at Ironstead examines every notice promptly, diligently, in a non-arbitrary and objective manner. Ironstead informs the person reporting of the decision by email, states whether automated means were used, and points out the options to challenge it (§ 16).
(4) Knowingly false notices are not permitted. Ironstead may handle recognisably abusive multiple notices together. Ironstead examines concrete indications of illegal content in every case.
§ 15 Measures
(1) Ironstead may take measures under paragraph 2 if a) content is illegal; b) content or conduct violates these terms, in particular §§ 3, 4, 8, 9, 12 or 13; c) a profile lacks mandatory details, in particular the legal notice; d) there are concrete indications of misuse, for example a profile under a false identity, fake reviews or a return under another name after removal from the directory; e) a legal obligation or an order of an authority or court requires it.
(2) Measures are: a) refusing to approve a profile; b) hiding or removing individual content, for example a profile photo, a profile text, an athlete post, an offer, a review or a reply, and not accepting a profile change examined under § 7(4); c) unlisting a profile; the coach cannot then relist it themselves; d) removing a coach from the directory under § 10(4); they can then no longer submit a profile; their Ironstead account and existing connections remain unaffected; e) for serious violations of the law, for example depictions of child sexual abuse, threats or fraud, suspending the Ironstead account; for coaches the GTC also apply.
(3) If a profile photo is reported as a depiction of child sexual abuse or as other illegal content, the system locks the photo automatically on receipt of the notice until a person has decided on the notice. The profile stays visible with a placeholder. This provisional lock is the only automated measure in the directory. The system also automatically detects profile changes containing links or contact details and holds them for examination (§ 7(4)); a person decides whether to accept them. A person takes all other decisions. Ironstead uses no other automated detection of content.
(4) Ironstead chooses the measure according to the severity, frequency and culpability of the violation and weighs the interests of everyone involved, including freedom of expression. As a rule, Ironstead first acts against individual content before unlisting a profile, and unlists a profile before removing a coach from the directory. In serious cases Ironstead may take the more far-reaching measure at once.
§ 16 Statement of reasons and complaints
(1) Ironstead gives the affected user reasons for every measure under § 15 by email to the address of their account, at the latest when the measure takes effect (Art. 17 DSA; towards coaches also Art. 4 of Regulation (EU) 2019/1150). This also applies to the provisional automatic lock under § 15(3); the statement then makes clear that no final examination has taken place yet. The statement names the content, the occasion, the measure, its start and duration, the ground with the provision concerned, whether automated means were used, and the options to challenge it. Ironstead names the person who reported only where strictly necessary. No statement is sent if the user cannot be reached, for example after deleting their account. Ironstead withholds individual details only where a specifically applicable statutory provision, or a binding order based on one, prohibits their disclosure.
(2) Ironstead is a micro enterprise. The obligations to run an internal complaint-handling system under Art. 20 DSA and Art. 11 of Regulation (EU) 2019/1150 do not apply to Ironstead (Art. 19 DSA, Art. 11(5) of Regulation (EU) 2019/1150). Ironstead offers the following complaint procedure voluntarily and models it on Art. 20 DSA.
(3) The affected user can complain against a measure under § 15 within six months of the statement of reasons. The person who reported can complain against a decision to take no action on their notice within six months of being informed. Complaints are free of charge. A reply to the email with the decision, or an email to abuse@iron-stead.com quoting the case number, is enough. A person examines the complaint; it is not decided solely by automated means. Ironstead usually decides within 14 days, informs the complainant of the result with reasons, and reverses the measure if it was not justified.
(4) The user may also turn to an out-of-court dispute settlement body certified under Art. 21 DSA. As a micro enterprise, Ironstead is not obliged to take part in such proceedings (Art. 19 DSA). Whether a body can conduct proceedings without Ironstead's participation depends on its rules of procedure. The courts remain open at all times; a complaint under paragraph 3 is not a precondition.
(5) Ironstead is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 17 Liability
(1) Ironstead is liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the German Product Liability Act, for fraudulently concealed defects and to the extent of any guarantee given.
(2) For simple negligence, Ironstead is liable only for breach of material contractual obligations. Material obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the user may regularly rely. In that case liability is limited to the damage that is typical for the contract and foreseeable.
(3) Otherwise Ironstead's liability is excluded. Paragraphs 1 to 3 also apply to the personal liability of Ironstead's vicarious agents. The limitations do not apply where mandatory law prevents them; in particular, claims under Art. 82 GDPR remain unaffected.
(4) The coach alone is responsible for coaching services and the performance of coaching contracts, and each user is responsible for their own content. Ironstead does not adopt users' content as its own. For third-party content Ironstead is liable under the statutory rules for hosting services (Art. 6 DSA). Ironstead's own statutory duties to examine, remedy and be liable remain unaffected.
(5) Maintenance and disruptions may temporarily restrict use of the directory.
§ 18 Term, changes, discontinuation
(1) The contract for using the directory runs for an indefinite period. Athletes can end it at any time without notice, through the "End directory use" function on the "Find a coach" page, by email to contact@iron-stead.com or by deleting their account; deleting the whole Ironstead account is not required. Ironstead may terminate it towards athletes with two weeks' notice by email; the right to terminate for good cause (§ 314 of the German Civil Code, BGB) remains unaffected. § 10 applies to coaches.
(2) If Ironstead changes these terms, it informs coaches of the content of the changes by email at least 15 days before they take effect. If the changes require technical or commercial adjustments by the coach, the period is reasonably longer. The period does not apply where Ironstead must change the terms because of a legal or regulatory obligation that does not allow the period to be observed, or to address an unforeseen and imminent danger to the directory, consumers or coaches from fraud, malware, spam, data breaches or other cybersecurity risks (Art. 3(4) of Regulation (EU) 2019/1150). The changes become part of the contract when the coach agrees to them; Ironstead asks for consent in the dashboard. Not terminating does not count as consent. Until consent, the previous terms continue to apply; Ironstead may then terminate participation under § 10(3).
(3) Towards athletes, changes take effect only if the athlete agrees to them. Ironstead informs athletes with an open request, an open athlete post or a published review of material changes by email. Ironstead asks for consent with the next request, athlete post or review and stores it with the version. If the athlete does not agree, the previous terms continue to apply; Ironstead may then terminate the contract under paragraph 1.
(4) Ironstead may discontinue the directory as a whole. It informs coaches at least 30 days and athletes at least two weeks in advance by email.
§ 19 Final provisions
(1) The law of the Federal Republic of Germany applies. If a consumer has their habitual residence in another state, the mandatory consumer protection provisions of that state remain applicable.
(2) If the coach is a merchant (Kaufmann under the German Commercial Code), a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the place of jurisdiction for disputes arising from these terms is Ironstead's seat (Hamm).
(3) The German version is binding. The English version is a non-binding translation.
(4) If individual provisions are invalid, the rest of the contract remains valid (§ 306 of the German Civil Code, BGB).
How we check reviews
Only someone who has an Ironstead account and was actively connected with the coach in Ironstead for at least 30 days in total can leave a review. Our system checks this from the connection data before every publication. Periods in which the connection was paused do not count. Periods from an earlier connection with the same coach do count. A coach cannot review themselves. Each athlete can review each coach once and can later change or delete the review.
We do not routinely check in advance whether coaching services were actually provided, whether there was a coaching contract, or whether individual statements of fact are true. When a review is challenged, we examine the statements concerned and, where necessary, ask for a statement or suitable evidence.
We show all reviews that do not violate the law or our terms of use, positive and negative, newest first. We do not sort or filter them by number of stars and do not change them. We show the average only from 3 reviews. We pay nothing for reviews, and coaches may not offer benefits for them. Coaches cannot delete a review themselves. They can reply publicly once and report a review.
We remove a review if, after examination by a person, it violates the law or our terms of use; the author then receives a statement of reasons. A review also disappears if the author deletes it, if we grant a justified erasure request, or if the reviewed coach's account is deleted. If an athlete deletes their account without deleting their reviews, their review remains as "Former athlete" until they ask for it to be deleted.

Effects of withdrawal
The contract is free of charge; we have received no payments from you and have nothing to refund.
